ICE officer shoots person in Marble Hill as accounts differ
Two law enforcement sources told CBS News the person shot may not have been the focus of the arrest, a account that differs from the one DHS gave on Thursday.
A federal immigration officer fired his weapon on Thursday afternoon in New York City, wounding a person during what the Department of Homeland Security called a “targeted enforcement operation.”
In brief
- The shooting took place at about 4 p.m.
- Their preliminary information was that ICE agents were attempting to detain someone, and that a different person, not the focus of the arrest, was the one shot.
- A CBS News analysis counted at least 30 shootings that involved DHS officers under the second Trump administration, some of them deadly.
What is confirmed so far
The shooting took place at about 4 p.m. in the Marble Hill neighborhood, close to the corner of West 225th Street and Marble Hill Avenue. According to NBC News, DHS said its officers were seeking a person from the Dominican Republic who had a prior grand larceny conviction. In its statement, the department said an Immigration and Customs Enforcement officer discharged his weapon and the person was injured.
DHS also said ICE officers rendered aid and that the injured person is alive and in a hospital. The NYPD said it was not involved in the incident and was not on scene when the shooting happened. It described the person as conscious and receiving medical attention at a nearby hospital. CBS News reported that, according to the NYPD, the injuries are not considered life-threatening.
Open questions about the car, the child and the target
One senior law enforcement official told NBC News that the person was apparently in a car at the moment at least one officer opened fire. Video from the scene, as described by CBS News, showed numerous law enforcement personnel and a gray vehicle with a bullet hole in the windshield stopped in the middle of the road.
Mayor Zohran Mamdani said early reports indicate a 5-year-old child was in the car with the man and was physically unharmed.
Two law enforcement sources gave CBS News a different picture from the one in the DHS statement. Their preliminary information was that ICE agents were attempting to detain someone, and that a different person, not the focus of the arrest, was the one shot.
DHS allegations about the person’s record
The department made a series of allegations about the injured person. They come from DHS, and NBC News and CBS News list the charges differently.
- A senior official told NBC News that the person has an open drug case.
- CBS News wrote that DHS alleged the person had been arrested before for assault and convicted of grand larceny, robbery, drug possession and weapons possession.
Whether the shooting was justified is not established, and the allegations above do not settle it.
Who is investigating and how officials responded
The FBI and Homeland Security Investigations responded to the scene. An FBI official said the bureau’s evidence response team was assisting investigators from DHS. In its statement, DHS said the incident remains under investigation and that more information will be shared as it becomes available.
Mamdani called the shooting “an unconscionable and incredibly serious situation” in a statement on X. He wrote: “I have called the President; when we speak I will demand that he ends all ICE enforcement actions in our city. I will not stand by while ICE agents terrorize our communities,”.
Gov. Kathy Hochul said she had been briefed on the shooting and expected a detailed report from federal authorities. In her post on X, she said New Yorkers deserve to know exactly what happened and why.
New York City Council Speaker Julie Menin said: “Federal authorities must provide us with a fully transparent account of what took place without delay.” Her post also expressed worry about the additional anxiety the incident may bring to communities across the city while residents await answers.
